Termini e Condizioni di Vendita

  • Condizioni generali di vendita

Tutti gli ordini e le relative condizioni di vendita si intendono accettati dopo l'acquisto sul nostro sito, salvo accordi particolari e prezzi Espressi in € Iva esclusa, si intendono sempre per merce resa franco nostro deposito.

  • Pagamenti

I pagamenti per tutti i clienti si intendono  anticipati, pagamenti dilazionati saranno possibili tramite Servizi appositi quali Klarna e/o altri tipi di finanziamento. 

 

  • Consegna

I termini di consegna convenuti si intendono sempre puramente indicativi eventuali ritardi causati da qualsiasi motivo, non daranno diritto al committente a nessun indennizzo, l'annullamento di un ordine richiesto dal cliente che dovrà essere fatto per iscritto, sarà eventualmente concesso a nostra descrizione e comunque mai dopo la consegna. La consegna si intende avvenuta dal momento in cui la merce viene affidata al vettore.

  • Resi

Non accettiamo mai resi senza previa autorizzazione ti preghiamo di contattare il servizio clienti per richiedere un Reso 

  • Garanzia

Tutti i nostri prodotti sono garantiti per la durata di 14 giorni dall'acquisto, la nostra Garanzia si limita semplicemente alla sostituzione del pezzo che deve essere Restituito, preventivamente a spese del compratore, presso il nostro magazzino, Rimane esclusa ogni responsabilità per i difetti derivanti da manomissioni degli Articoli forniti, errata installazione o errato uso durante l'impiego e il montaggio degli stessi.

 

1. Calcolo di Spedizioni e Tasse

Per tutti i prodotti in preordine e le resine i costi di spedizione e le eventuali tasse di importazione non vengono calcolati al momento dell'acquisto, ma solo quando l'articolo è fisicamente disponibile presso il magazzino dello spedizioniere.

Da mettere in conto la maggiorparte delle resine viene spedita dall'asia che è anche il luogo di produzione di queste ultime. 

2. Saldo e Tempistiche

Una volta che l'oggetto è pronto per l'invio, il cliente riceverà una notifica di pagamento. Dal momento della ricezione della richiesta, il cliente ha a disposizione un termine perentorio di 72 ore per saldare l'importo relativo alla spedizione e agli oneri fiscali. L'importo della spedizione per alcuni prodotti può variare a seconda della dimensione e del peso del articolo, range di prezzi:

0 a 5 kg vanno da 100 a 290€ iva e oneri doganali esclusi 

5 a 10 kg vanno da 290€ a 850€ iva e oneri doganali esclusi

10 a 15 kg vanno da 850€ a 1.200€ iva e oneri doganali esclusi 

Da 20 kg in poi vanno da 1.200€ a 3.500€ iva e oneri doganali esclusi 

I presenti importi sono indicativi e non assoluti, e variano a seconda del periodo di ordine, le spedizioni di questi oggetti verranno effettuate via Aerea o trasporto su ruote. 

Le spedizioni delle resine vengono effettuate principalmente da Giappone e Cina. 

3. Validità della "Spedizione Gratuita"

La dicitura "Spedizione Gratuita" visualizzata automaticamente dal sistema durante il checkout è da considerarsi non valida qualora la descrizione specifica del prodotto indichi diversamente. Invitiamo i gentili clienti a leggere attentamente la scheda descrittiva di ogni articolo per evitare malintesi. In caso di discrepanze, prevalgono sempre le informazioni contenute nella descrizione del prodotto.

4. Mancato Pagamento e Risoluzione Contrattuale

Il mancato saldo della spedizione e delle tasse entro le 72 ore previste comporterà l'annullamento immediato dell'ordine. In tale eventualità:

L'ordine sarà considerato decaduto.

Eventuali depositi cauzionali, acconti o pagamenti completi già effettuati non saranno rimborsabili, a titolo di risarcimento per la gestione dello stock e la riservazione del prodotto, qualora un pagamento completo venisse utilizzato per prenotare e assicurare quindi la disponibilità di una resina in limited edition, non potrà essere richiesto rimborso in quanto l'importo pagato verrà utilizzato per assicurare la disponibilità della figure richiesta e quindi bollato come deposito NRD

5. Depositi

Tutti gli importi richiesti per la prenotazione di un prodotto sono da considerarsi, depositi NRD

6. Depositi e PayPal

 

Una volta effettuato un pre ordine tramite PayPal, qualsiasi contestazione aperta farà decadere direttamente l'ordine, una volta che l'oggetto sarà disponibile per la spedizione, l'ordine verrà segnalato a PayPal come elaborato, il pre ordine è da considerarsi un servizio, e come tale va trattato, una volta chiuso il contesto PayPal si procederà con la spedizione del prodotto.

7. Esclusione del Diritto di Recesso per Prodotti Artigianali e Limited Edition

Data la particolare natura dei prodotti trattati da FiguresZone, si applicano le seguenti esclusioni al diritto di recesso (rif. Art. 59 Codice del Consumo):

  • Natura Artigianale: Le resine (GK Statues) sono prodotti artigianali realizzati in tiratura limitata o su ordinazione. Tali beni sono considerati "confezionati su misura o chiaramente personalizzati" e, pertanto, non sono soggetti al diritto di recesso una volta che l'ordine è stato processato e confermato con il deposito.
  • Svalutazione Collezionistica: La natura di questi oggetti prevede che il valore risieda nell'integrità assoluta del packaging. L'apertura della confezione originale (Art Box) di una statua in edizione limitata ne compromette definitivamente il valore di mercato, rendendo l'oggetto non più rivendibile come nuovo.

8. Integrità dei Prodotti e Diminuzione di Valore

Per tutti gli altri articoli (Action Figures, Model Kit, ecc.), il diritto di recesso è subordinato alla restituzione del bene nel suo stato originale:

  • Sigilli e Plastiche: Le plastiche protettive interne, i blister, i sigilli di fabbrica e le pellicole contenitive sono considerati parte integrante del prodotto.
  • Limitazioni al Rimborso: In caso di restituzione di prodotti con plastiche rimosse, sigilli rotti o confezione interna manomessa, il cliente è responsabile della drastica diminuzione del valore del bene. In tali circostanze, ci riserviamo il diritto di rifiutare il reso o, in alternativa, di trattenere una quota dal rimborso (fino all'100% del prezzo di vendita) commisurata alla svalutazione del prodotto ormai considerato "usato".
  • Resi non autorizzati: Qualsiasi reso effettuato senza la preventiva autorizzazione scritta del nostro staff, o spedito con modalità che mettano a rischio l'integrità del bene, non verrà accettato o verrà gestito applicando penali per oneri di gestione e ripristino stock.

### General Conditions of Sale
All orders and their respective conditions of sale are considered accepted upon purchase on our website, unless special agreements are made. Prices are expressed in € (EUR) excluding VAT and are always intended for goods delivered Ex Works (EXW) our warehouse.
### Payments
Payments for all customers are intended to be made in advance. Deferred payments will be possible through specific services such as Klarna and/or other types of financing.
### Delivery
Agreed delivery terms are always to be considered purely indicative. Any delays caused by any reason will not entitle the buyer to any compensation. The cancellation of an order requested by the customer must be made in writing; it may be granted at our sole discretion and, in any case, never after delivery has occurred. Delivery is considered to have taken place from the moment the goods are handed over to the carrier.
### Returns
We never accept returns without prior authorization. Please contact customer service to request a return.
### Warranty
All our products are guaranteed for a duration of 14 days from purchase. Our warranty is strictly limited to the replacement of the part, which must be returned beforehand at the buyer's expense to our warehouse. Any liability for defects resulting from tampering with the supplied items, incorrect installation, or improper use during the handling and assembly of the same remains excluded.
### 1. Calculation of Shipping and Taxes
For all pre-order products and resins, shipping costs and any import taxes are not calculated at the time of purchase, but only when the item is physically available at the shipping forwarder's warehouse.
Please note that the majority of resins are shipped from Asia, which is also their place of production.
### 2. Balance and Timing
Once the item is ready for shipment, the customer will receive a payment notification. From the moment the request is received, the customer has a strict deadline of **72 hours** to settle the amount relating to shipping and tax charges. The shipping amount for certain products may vary depending on the size and weight of the item. Indicative price ranges:
 * **0 to 5 kg:** from €100 to €290 (excluding VAT and customs duties)
 * **5 to 10 kg:** from €290 to €850 (excluding VAT and customs duties)
 * **10 to 15 kg:** from €850 to €1,200 (excluding VAT and customs duties)
 * **From 20 kg onwards:** from €1,200 to €3,500 (excluding VAT and customs duties)
These amounts are indicative and not absolute, and they vary depending on the order period. Shipments of these items will be carried out via air freight or road transport.
Resin shipments are mainly carried out from Japan and China.
### 3. Validity of "Free Shipping"
The "Free Shipping" text automatically displayed by the system during checkout is to be considered invalid if the specific product description indicates otherwise. We kindly invite customers to read the description sheet of each item carefully to avoid misunderstandings. In case of discrepancies, the information contained in the product description shall always prevail.
### 4. Non-Payment and Contract Termination
Failure to settle the shipping balance and taxes within the required 72 hours will result in the immediate cancellation of the order. In this event:
 * The order will be considered null and void.
 * Any security deposits, down payments, or full payments already made will be **non-refundable** as compensation for stock management and product reservation. If a full payment is used to book and thus secure the availability of a limited edition resin, no refund can be requested, as the paid amount will be used to secure the availability of the requested figure and will therefore be marked as a Non-Refundable (NR) deposit.
### 5. Deposits
All amounts requested for booking a product are to be considered Non-Refundable (NR) deposits.
### 6. Deposits and PayPal
Once a pre-order is placed via PayPal, any open dispute will directly void the order. Once the item is available for shipment, the order will be reported to PayPal as processed. The pre-order is to be considered a service and must be treated as such; once the PayPal dispute context is closed, the product shipment will proceed.
### 7. Exclusion of the Right of Withdrawal for Handcrafted and Limited Edition Products
Due to the special nature of the products sold by FiguresZone, the following exclusions to the right of withdrawal apply (ref. Art. 59 of the Italian Consumer Code):
 * **Handcrafted Nature:** Resins (GK Statues) are handcrafted products made in limited runs or made-to-order. Such goods are considered "made to measure or clearly personalized" and, therefore, are not subject to the right of withdrawal once the order has been processed and confirmed with a deposit.
 * **Collectible Depreciating Factor:** The nature of these items dictates that their value resides in the absolute integrity of the packaging. Opening the original packaging (Art Box) of a limited edition statue permanently compromises its market value, making the item no longer resellable as new.
### 8. Product Integrity and Value Reduction
For all other items (Action Figures, Model Kits, etc.), the right of withdrawal is subject to the return of the asset in its original condition:
 * **Seals and Plastics:** Internal protective plastics, blisters, factory seals, and wrapping films are considered an integral part of the product.
 * **Refund Limitations:** In the event of a return of products with removed plastics, broken seals, or tampered internal packaging, the customer is responsible for the drastic reduction in the value of the good. In such circumstances, we reserve the right to refuse the return or, alternatively, to deduct a portion from the refund (up to 100% of the sale price) proportionate to the devaluation of the product, which is now considered "used".
 * **Unauthorized Returns:** Any return carried out without the prior written authorization of our staff, or shipped using methods that jeopardize the integrity of the good, will not be accepted or will be managed by applying penalties for management fees and stock restoration.
